The present conditions apply to all persons who access and use the Easyplus Home Control app (EPHC) and the Easylink PC software (hereinafter the ‘Application/Application(s)’).

By using an Apex Systems International Application (called here after the “Use”), the user acknowledges to have read the following terms and conditions and to agree in full, unconditionally and expressly with their contents.
Unless otherwise indicated, ‘ASI’ on our Applications refers to Apex Systems International BVBA, with registered office at Hermesstraat 6c, 1930 Zaventem and KBO number 0477.879.507, and where applicable the companies, logos, company names and/or trademarks of the companies that are directly or indirectly affiliated with Apex Systems International BVBA.
The information on this website is periodically changed. Apex Systems International BVBA reserves the right to make improvements and/or changes to this Disclaimer at any time. You are therefore requested to consult this page regularly.

Usage Guidelines

By using an Application, you agree to:
• Not to take any action that interferes with the use of that Application by other users, or that disrupts the security of this Application
• Do not upload viruses or other harmful files on an Application
• Do not (try to) use the account, password or system of another user without authorization from ASI.
If you wish to log in to an Application as a registered user, you must comply with our privacy policy (see below) and act as a diligent member of the ASI community at all times. With regard to the data that you entrust to ASI, you expressly declare:

  • that they do not contain logos or other elements that are protected by intellectual property rights or personality rights (e.g. portrait rights, right to good name) of third parties, and
  • that these are not in any way contrary to public order, morality or other rights of third parties.
    As a registered user, you indemnify ASI against all third-party claims based on non-compliance with the above statement. ASI cannot accept any liability for material entrusted to it by users.

EXCLUSION OF THE PERSONAL ACCESS CODE

ASI has the right to block access to its Applications for a user in the following cases:

  • in case of unauthorized use by the user of an Application,
  • in case of violation of the conditions contained in this Disclaimer,
  • if ASI deems this useful or necessary for the security of the system, or to safeguard its interests or those of the user, or other users,
  • in the event of notification by the user to ASI of the loss or theft of the personal login and password, or of any misuse or suspected misuse of the personal login and password by a third party.
    ASI assumes that the content of messages or files of any kind posted on the Application emanates from the user and is in accordance with his will, unless the user has notified ASI of loss or misuse of his personal login.

UNAVAILABILITY OF APPLICATIONS

ASI reserves the right to suspend service through its Applications for maintenance or to make changes or improvements to the system.
ASI also reserves the right to change its Applications, the personal log in as well as the security measures, for example when the evolution of technology and security systems, or the evolution of the applicable laws and regulations so requires.
ASI does not guarantee the proper functioning of its Applications and can in no way be held liable for any malfunction or for a temporary or permanent unavailability of EPHC or for any form of damage that would directly or indirectly result from access to or the use of EPHC. The content of any Application (including links) may be taken offline, modified, modified or supplemented at any time, in whole or in part, without notice or notice.

LIABILITY

1)  Information on the Applications

The information on our Applications is general and, where appropriate, commercial in nature. The information is not exhaustive. Despite our reasonable efforts, the information may not be accurate, current, or applicable to the circumstances of a particular case. Accordingly, we do not accept any liability for any inaccuracies or omissions (other than fraudulent misrepresentation) in any Application.
Any decisions you make based on the information on an Application are your sole responsibility. ASI disclaims all liability for any loss or damage arising directly, indirectly or otherwise from the use of an Application or the information contained therein. The foregoing applies regardless of the nature of the loss or damage.

2) Using the Applications

We are under no obligation to update the information on our Applications. Notwithstanding, ASI is entirely free to take down and modify any Application, in whole or in part, at any time without prior notice or announcement being required.
In addition, ASI does not provide any guarantees regarding the proper functioning of the Applications. Regardless of the cause, we can therefore not be held liable for the malfunctioning or inaccessibility of an Application.
In no circumstances shall ASI be liable for consequential damages, lost profits, work stoppages, damage to programs or other data on the computer system, as well as for damage to equipment, software or other assets of the user.

INTELLECTUAL PROPERTY RIGHTS ON THE APPLICATIONS

The content and data that can be downloaded from the Applications are all protected by intellectual property rights, such as, but not limited to copyright and related rights, trademark law, patent law and rights to trade names, logos, drawings , models, software, databases and inventions, as well as applications for such rights (hereinafter “Intellectual Property Rights”). The Intellectual Property Rights always belong to ASI or third parties with whom ASI has made the necessary agreements.
It is your responsibility to comply with all existing laws protecting Intellectual Property Rights. Consequently, you undertake to refrain from any possible infringement of the Intellectual Property Rights of EPHC or of the third parties mentioned above.
Unless and to the extent expressly and legally permitted by law, or unless you obtain ASI’s prior written consent, any reuse of an Application for non-commercial and/or commercial purposes is strictly prohibited.
At the simple request of ASI, you will immediately terminate any reproduction or other exploitation of the aforementioned Intellectual Property Rights. You may not embed or link to the Application without our express permission.

USE OF HYPERLINKS

The Applications may contain hyperlinks to third party websites or pages. When we provide a hyperlink to a third party website, it is because we believe in good faith that this website contains or may contain relevant information related to our Applications. The presence of such hyperlinks does not mean that ASI has analyzed the relevant website(s) or approves these website(s) or their content. In some cases, a hyperlink may also direct you to a third party website that contains opinions that conflict with opinions expressed in any of our Applications, or otherwise expressed by ASI.
Neither we nor our affiliates are responsible for the content of other websites, including any websites through which you may access any of our Applications, any websites that you may have accessed through any of our Applications, as well as any websites that we would refer to, even indirectly, on any of our Applications. We do not accept any liability with regard to such websites or links. We expressly declare that we have no control over the content or other features of any other website belonging to a third party. Accordingly, we are not liable for any damage attributable to the content or features of such websites.
In the event that you would like to provide a hyperlink to one of our Applications, you should always send a request in advance by e-mail to ASI: info@apexsyst.com. Thus, the pages of one Application may not be incorporated into the pages of another website.

VOID OR INVALID PROVISIONS

Should any provision in this document be found to be unlawful, invalid or unenforceable in whole or in part for any reason, such provision shall be severable from the remaining provisions which shall remain valid to the fullest extent permitted by law. With respect to the invalid provision, you agree that it will be replaced by a new provision that approximates the will of the parties as closely as possible, while remaining within the limits of what is permitted by law.

APPLICABLE LAW

The use of our Applications and the data downloaded from them are governed by Belgian law. In the event of any dispute arising from your use of an Application, the courts and tribunals of Leuven shall have jurisdiction.

Privacy Policy

ASI attaches great importance to protecting the privacy of all persons who use its applications. ASI is therefore committed to processing (your) personal data in a legal, fair and transparent manner. We recommend that you read this Privacy Statement carefully, as it applies to the EPHC app and the Easylink PC Software (hereinafter the ‘Application(s)’). With this statement, ASI wants to inform you in more detail about the processing of (your) personal data specifically with regard to the use of (one of) the Applications. By using an Application of ASI (hereinafter the “Use”), the user acknowledges to have read this privacy statement and to fully, unconditionally and expressly agree with its contents.


(1) OWNER AND RESPONSIBLE FOR PROCESSING 

1.1 Apex Systems International BVBA with registered office at Hermesstraat 6c, 1930 Zaventem and KBO number 0477.879.507 (hereinafter ‘ASI), is the owner of the Applications and responsible for the processing of your personal data as determined below.

(2) WHAT DATA DOES ASI COLLECT? 

2.1 During your Use, the servers located with ASI and/or those hosted on behalf of ASI by third parties, based on your IP address(es), questionnaire completion or in any other way (whether or not not automatically) collect information about your Usage.

2.2 The information stored by ASI may therefore contain some of your personal data. More specifically, this concerns the following information (hereinafter referred to as the ‘Information’): Name, Surname, Address, Telephone number, Email address and possibly VAT number. Login and password details are also stored.

2.3 When you request information yourself via the Application (eg your building details), we may want to receive Information from you. If necessary, your personal data will be processed in order to respond to your questions and also to provide you with information, goods, products and required services in the desired form.

2.4 When we ask you for Information, we ensure that the collection and use is strictly in accordance with the provisions of the applicable legislation on personal data protection and respect for privacy. As stated, by downloading, installing and/or using an Application, you agree to the Privacy Statement, and therefore to the processing of your Information.

2.5 However, the Information does not identify you as an individual. They will only be able to identify your Easyplus Home Controller or other device that you use for a Use.


(3) THE PURPOSES: FOR WHAT DOES ASI COLLECT AND PROCESS YOUR DATA? 

3.1 The non-anonymized Information collected by us will be used for the following purposes:
(a) allow You to download and install an Application, to enable your registration and authentication in Use, as well as to use and access the Application, including filling out questionnaires;
(b) optimizing the operation and security of the Applications for the benefit of all users; and
(c) conducting direct marketing
3.2 If we consider using your personal data for purposes other than those originally planned (see above), we will always ask for your prior consent or inform you in good time about any changes to the Privacy Statement to that effect.


(4) DATA RETENTION

4.1 Your Information will be stored from its receipt and for the period necessary to enable us to contact you efficiently regarding your Easyplus Home Control system. The data is then deleted. We do not collect any Information about you other than described under point 2.2 above.
4.2 To protect the personal data under our control, we apply policies, rules and security techniques in accordance with applicable privacy laws in the jurisdiction of the Applications. The security measures are intended to prevent any unauthorized access, incorrect use or disclosure, unauthorized modification and unlawful destruction or accidental loss.

(5) ACCESS TO YOUR PERSONAL DATA AND COMMERCIAL USE

5.1 In accordance with the law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, you have the right to free access and correction of your personal data.
You can exercise your rights by sending an e-mail to info@apexsyst.com, or by sending us a letter at the address specified in point 1.1. You must always enclose a copy of your identity card with such an e-mail or letter.
5.2 You have the right to object to direct marketing free of charge, and you can exercise this right by contacting ASI at the address stated in point 1.1 or via info@apexsyst.com.

(6) COOKIES 

6.1 During your Use, small text files called “cookies” may also be automatically downloaded to the computer, mobile device or any other device you use to use our Applications.
1) What is a cookie?
6.1.1 The term “Cookies” includes all mini-files that are provisionally stored on the visitor’s workstation or the server of an Application, and contain extracts of information exchanged during a message exchange between the internet user and the server – which in turn with the “web” is connected – was transferred or generated. Cookies are therefore in fact traces of the dialogue that has taken place between the internet user and the server. In other words, they are pieces of information that are stored on your device by the server that maintains and operates the Application. Cookies store a simple, random identifier on your computer.
The cookies on your device are managed by your web browser.

2) Your consent
6.2.1 Unless they are placed for the sole purpose of carrying out the transmission of a communication via an electronic communications network or to provide a service expressly requested by you when this is strictly necessary, the use of Cookies will always save your prior require permission.
6.2.2 By downloading, installing or using an Application, you therefore agree that ASI may store information on your device and access information from your device. In particular, this concerns information such as technical information about the device, its number, mobile applications on the device, name of the device, email address installed on the device, relevant identifiers of the device, OS version, telecom operator name, telephone number and SIM card number. You also accept that the (informed) continued surfing (“further browsing”) will be regarded as a positive action with which you give your consent.
3) Why do we use cookies?
6.3.1 Cookies primarily enable us to provide you with a better and more personalized service and user experience. They also make it possible to learn more about how an Application works. In some cases, your preferences are saved so that your Use can be better tailored to your needs. The collected data is also used to compile anonymous statistics and to improve the quality of the website.
Cookies provide us with information about the number of visits to the website, the date and time of the visits, the websites that are clicked through, and so on.
Finally, Cookies (if applicable) are also stored on your device for the purposes described under point 3 of this Privacy Statement.
6.3.2 Under no circumstances will ASI use Cookies for other purposes or transfer them to third parties without obtaining your prior consent.
6.3.3 Cookies do not contain any personally identifiable information and it is therefore not possible to identify an individual from their cookie data. Cookies only identify the device used to view the Application.
4) What types of cookies are used for our Applications?
6.4.1 The Application(s) uses Cookies for:
(i) Connection and authentication as a registered member; and
(ii) Preference storage,
6.4.2 Under no circumstances are Cookies collected that relate to health data or sensitive information.
5) How can I manage cookies?
6.5.1 Any participant may object or withdraw his or her consent at any time by interrupting the installation of an Application or removing an Application already downloaded and installed from his or her device.
6.5.2 In addition, you have several other options for managing cookies. By adjusting the settings of your web browser, you can change your navigation on the internet as well as the access conditions for certain services that require the use of cookies. You can also choose to disable all cookies at any time, or change your cookie preferences through the means described below.

Different cookie settings apply per browser. You can choose to set your browser to store cookies on your workstation or to delete them altogether, either systematically or on a sender basis.
You also have the option of setting your browser to ask you each time whether you want to accept or decline cookies, even before a cookie is stored on your computer.
However, we would like to point out that certain types of cookies are crucial for the functioning of certain services offered through an Application. This is the case, for example, if you try to access content or services that require identification.
The configuration differs per browser. This is described in the Help menu of your browser, which will allow you to know how you can adjust your wishes regarding cookies.

6) How long does ASI store the Cookies?
6.6.1 The data collected on the basis of Cookies are stored for a maximum of two years. If you do not want Cookies, you can refuse them via your browser as stated above.


(7) HYPER LINKS 

7.1 An Application may contain links to third party websites for your convenience and information. Clicking on these links will exit the ASI Application. ASI is not responsible for the content, nor for the privacy practices on such websites, which may differ from ASI’s policies. We also do not endorse or represent any third-party websites. The personal information you choose to provide to unaffiliated third parties is not covered by ASI’s Privacy Statement and Policy. We recommend that you consult the privacy policies of the companies to which you provide your personal data.
7.2 Some other companies may choose to share their personal data with ASI; this communication is governed by the privacy policy of that third party.

(8) COMPLIANCE WITH THE RULES ON THE PROTECTION OF PERSONAL LIFE

8.1 These provisions are in accordance with the law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, and are intended to protect your privacy. We would like to receive your wishes and comments in response to this.

9.1 As a participant you are aware that the processing of personal data can evolve under the influence of various factors such as changing regulations, technical developments and changes in processing purposes.
